Email Accounts Terms & Conditions

(previously total email)

If you order or are subscribed to an Email Account (mailbox) from totality services London Limited you (“Customer”, “You” or “Your”) hereby agree to these Terms & Conditions for Email Account services.

These terms are supplemental to Your contract with totality services. You will be bound to both documents (collectively referred to as the “Agreement”). If there is any conflict within the Agreement, these Terms & Conditions for Email Accounts will prevail.

These additional terms may be amended by totality services at any time and without notice to You. Any changes will be published on the website and will be deemed to have been accepted 7 days after publication.

1. Spam

Customers engaged in the sending of unsolicited bulk email will have their Email Accounts (mailboxes) temporarily suspended if discovered.

 

2. Payment

You must make monthly payments in advance or on the day of the start of each billing period, by bank transfer, Standing Order or Direct Debit. Payment must be made in full as per these conditions, failure to do will result in the automatic suspension of your account – this includes Email Accounts, IT support, Hosting and Data Backups.

 

3. Illicit and illegal material

Any incoming or outgoing email correspondence and / or attachments must comply with UK law, including copyright law and laws concerning obscene, offensive and discriminatory material.

 

4. Charges

Should you wish to vacate your Email Accounts (mailboxes), you may do so provided that payments on your totality services account are fully up to date. At the end of any particular billing period, non-payment of the account will be taken as termination by the customer. Once termination has taken place, the emails will be unavailable for access by the client so we do suggest that removal of any emails is carried out prior to termination.

Should an account be suspended due to customer request or non-payment, a reconnection charge of £200 will be levied and must be paid, together with any outstanding amounts, prior to un-suspension.

totalty services reserve the right to amend our charges without notice.

 

5. VAT

All charges are exclusive of VAT, which must be paid by the customer if due.

 

6. Backups

totality services takes daily backups of all emails This is carried out in good faith but we cannot be held responsible for failure of the server or the backup.

 

7. Liability

In no event shall totality services be liable for any loss of profits, loss of business, or any indirect, special, exemplary, punitive, incidental or consequential damages as the result of any such action or inaction without regard to the likelihood of any such damages.

totality services is not responsible for any delay, lack of connection, slow connection, loss of data, loss of usability, or any other similar issues, due, but not limited to, any of the following:

  1. The active or passive negligence of totality services, You or any third party
  2. Downtime due to scheduled maintenance
  3. An upgrade, downgrade or other alteration to Your Services
  4. Hardware failure, (including issues caused by other users on hardware)
  5. Your error

 

totalty services may limit or deny access to Your Services and its systems if, in totality services’ judgment and sole discretion, such action is required to prevent damage to the network (including, but not limited to, software and stored data) or to ensure the integrity or security of the network.
